Château d’Anvichar SAS is responsible for the processing of personal data implemented in France. In accordance with Regulation No. 2016-679 of April 27, 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, the purpose of this privacy policy is to inform you of our practices regarding the collection, use and sharing of the information you provide to us.

In the United States, this website is offered by Castillon, LLC (Château d’Anvichar SAS and/or Castillon, LLC are referred to as the “Company” or “we”). We respect your privacy and are committed to protecting it by adhering to this policy. This policy describes the types of information we may collect from you or that you may provide when you visit the www.anvichar.com or www.anvichar.fr website (collectively the “Site”) and our practices for collecting, using, maintaining, protecting and disclosing that information.

When you browse the Site, you are required to send us information, some of which may identify you. This data includes :

Users under legal age

The Site is not intended for anyone under the legal age to purchase alcoholic beverages in the country from which the Site is accessible. We do not control the collection or use of your information by third parties to deliver interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this manner. You may opt-out of receiving targeted advertising from Network Advertising Initiative (“NAI”) members on the NAI Web Site.

Data security

We have implemented measures designed to protect your personal information against accidental loss and against unauthorized access, use, modification and disclosure. All payment transactions will be encrypted using SSL technology.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password to access certain parts of the Site, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.

Unfortunately, the transmission of information via the Internet is not totally secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to the Site. Any transmission of personal information is at your own risk. We are not responsible for the circumvention of privacy settings or security measures contained on the Site.

Data retention period

Data will not be retained beyond the time strictly necessary for the purposes identified in the Privacy Policy, and in accordance with applicable laws.

Data used for the purposes of the online contact form are retained for the duration of the request processing.

Newsletter subscription data is kept for the duration of the newsletter subscription.

Online purchase data is kept for the duration of the commercial transaction and up to three (3) years after the last exchange with the customer.

Data collected as part of the sales process is kept for no longer than three (3) years after our last exchange with the user.

Your data is deleted on expiry of the retention periods. However, they may be archived for longer periods for research purposes and as required by law.

We make such commercial disclosures only pursuant to written contracts that describe the purposes, require the recipient to keep the personal information confidential and prohibit the use of the disclosed information for any purpose other than the performance of the contract. During the previous twelve (12) months, the Company disclosed personal information for commercial purposes to the categories of third parties indicated in the table below.

We do not sell personal information.

Your rights and choices

Right to information and data portability

You have the right to ask us to disclose certain information about our collection and use of your personal information over the past 12 months (the “right to know”). Once we have received your request and confirmed your identity (see Exercising your right to know or delete), we will disclose to you :

  • The categories of personal information we have collected about you.

  • The categories of sources for the personal information we have collected about you.

  • Our business or commercial purpose for collecting or selling this personal information.

  • The categories of third parties with whom we share this personal information.

    • sales, identifying the categories of personal information each category of recipient has purchased;

Right of deletion

You have the right to ask us to delete any personal information we have collected from you and retained, subject to certain exceptions (the “Right of Deletion”). Once we have received your request and confirmed your identity (see Exercising your rights of knowledge or deletion), we will review your request to see if an exception allowing us to retain the information applies. We may refuse your request for deletion if retaining the information is necessary for us or our service provider(s) to:

  1. Complete the transaction for which we collected the personal information, provide a good or service requested by you, take reasonably anticipated actions in the course of our ongoing business relationship with you, fulfill the terms of a written warranty or product recall made pursuant to federal law, or otherwise perform our contract with you.

  2. Detect security incidents, protect against or prosecute malicious, deceptive, fraudulent or illegal activities.

  3. Debug products to identify and repair errors that interfere with existing intended functionality.

  4. Exercise freedom of speech, guarantee the right of another consumer to exercise his or her right to freedom of speech, or exercise any other right provided by law.

  5. Comply with California’s Electronic Communications Privacy Protection Act (California Penal Code § 1546 et seq. ).

  6. Engage in public or peer-reviewed scientific, historical or statistical research in the public interest that complies with all other applicable ethics and privacy laws, where deletion of the information would likely make it impossible or seriously interfere with the conduct of the research, if you have already given your informed consent.

  7. Allow only internal uses that are reasonably aligned with consumer expectations based on your relationship with us.

  8. To comply with a legal obligation.

  9. Make other internal and legal uses of this information that are consistent with the context in which you provided it.

We will delete or de-identify from our records personal information that is not subject to one of these exceptions, and we will require our service providers to take similar steps.

Exercising your rights of knowledge or deletion

To exercise your rights of knowledge or deletion described above, please submit a request by sending us an e-mail to admin@anvichar.com.

Only you, or a person legally authorized to act on your behalf, may make a request for knowledge or deletion related to your personal information.

You may submit a request for knowledge only twice in any 12-month period. Your request for knowledge or deletion must :

  • Provide sufficient information that allows us to reasonably verify that you are the person about whom we have collected personal information or an authorized representative, which may include:

    • Your postal address

    • Order history

    • Your date of birth

  • Describe your request in sufficient detail to enable us to fully understand, evaluate and respond to it.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm that the personal information is about you.

You do not need to create an account with us to submit a knowledge or deletion request.

We will only use the personal information provided in the request to verify the requestor’s identity or authority to do so.

Timing and format of response

We will confirm receipt of your request within ten (10) working days. If you do not receive confirmation within 10 days, please contact us again at admin@anvichar.com.

We strive to substantially respond to a verifiable consumer request within forty-five (45) days of receipt. If we need more time (up to an additional 45 days), we will inform you of the reason and the extension period in writing.

If you have an account with us, we will provide you with our written response to that account. If you do not have an account with us, we will send you our written response by mail or electronically, at your option.

Any disclosure we provide will only cover the 12-month period preceding receipt of your request. The response we provide will also explain why we are unable to respond to a request, if applicable. For data portability requests, we will select a format for providing your personal information that is easily usable and should allow you to transmit the information from one entity to another without hindrance.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive or manifestly unfounded. If we determine that the request warrants a fee, we will explain why we have made this decision and provide you with an estimate of the cost before we complete your request.

Rights to sell personal information

If you are 16 years of age or older, you have the right to ask us not to sell your personal information at any time (the “Opt-Out Right”). We do not sell the personal information of consumers we know to be under 16 years of age. Consumers who register for the sale of personal information may opt out of future sales at any time.

Once you have requested to unsubscribe, we will wait at least twelve (12) months before asking you to re-authorize the sale of personal information. However, you can change your mind and re-register for the sale of personal information at any time by emailing us at admin@anvichar.com.

You do not need to create an account with us to exercise your opt-out rights. We will only use the personal information provided in an unsubscribe request to review and comply with the request.

Non-discrimination

We will not discriminate against you for exercising any of your CCPA rights. Unless authorized by the CCAC, we will not :

  • Refuse you goods or services.

  • Charge you different prices or rates for goods or services, including discounts or other benefits, or impose penalties.

  • Provide you with a different level or quality of goods or services.

  • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

However, we may offer you certain financial incentives permitted by the CCAC that may result in different prices, rates or quality levels. Any CCPA-authorized financial incentives we offer will be reasonably related to the value of your personal information and will contain written terms describing the material aspects of the program. Participation in a financial incentive program requires your prior consent, which you may revoke at any time. We do not currently offer any financial incentives.

Rights of users of the French Web Site

Residents of France who use the Site have the following rights:

– Right of access: this right enables you to question Château d’Anvichar SAS to find out whether it holds personal data about you and to obtain communication about this data.

– Right of rectification: this right enables you to ask Château d’Anvichar SAS to rectify and update your personal data if it is inaccurate or incomplete.
